先週の木曜日（2024年6月27日）に東京ボランティア市民活動センター（飯田橋）にて、「日本の重国籍問題：事例判例（ちょこっと）勉強会」研究会を実施しました。まず、話題提供者の井口博充さんと野崎与志子さんから、貴重な資料や独自の解釈なども交えながら日本の重国籍問題に関する数々の事例や判例を中心にお話しいただきました。特に現在行われている都知事選を念頭に、「蓮舫二重国籍問題」も取り上げられ、その趣旨は以下のようなものでした。

「蓮舫氏は法務省の国籍実務からするともともと「二重国籍」ではなかったと考えられる。「蓮舫二重国籍問題」はポリティカルな文脈で出てきたもので、 法務省「不可解」対応とマスコミ報道迷走をもたらしたのは、（あ）「国籍唯一原則」を採用しているとされる日本の国籍法と現実には生来の重国籍者の存在を容認せざるをえない矛盾、および（い）国交のない中華民国国籍保持者を日本の国籍法でどのように取り扱うか、と言うグレーゾーンと中華民国の国籍法/実務の複雑性に起因すると考えられる。国籍法11条1項は明治憲法下の国籍法から継承さているものであるが、様々な裁判で争われてきており、世界の潮流を見ながら再検討を要すると言える。」

話題提供の後の質疑応答も1時間を超えるもので、とても熱のこもったものでした。

また、今回は、勉強会ということで、多文化研メンバーが執筆した書籍を含む複数の必読書が紹介、回覧もされました。その場でネット購入された方もいたようです。

なお、会場は、飯田橋駅ビル10階にあり、特に浦和や東松山からの参加者の方が便利だと言っておられたのが印象的でした。

次回は7月31日17時から同じ会場を予定しています。

詳細は後日またお知らせしますが、今回に続いて学会風の研究発表ではなく、勉強会形式を予定しています。

On Thursday, June 27, 2024, we held a workshop titled “Japan’s Dual Nationality Issue: Case Studies and Legal Precedents” at the Tokyo Volunteer Center in Iidabashi. Our speakers, Hiroyuki Inokuchi and Yoshiko Nozaki, shared valuable materials and their insights on various cases and legal precedents related to Japan’s dual nationality issues. They also discussed the “Renho Dual Nationality Issue,” especially relevant with the ongoing Tokyo governor election. They concluded:

“Under the Ministry of Justice’s nationality procedures, Renho was not originally a dual national. The ‘Renho Dual Nationality Issue’ emerged in a political context, leading to confusing responses from the Ministry and media. This confusion arises from the contradiction between Japan’s ‘Single Nationality Principle’ and the reality of people born with dual nationality, as well as the complex issue of how to handle nationals of the Republic of China (Taiwan), with whom Japan has no diplomatic relations. Article 11 of the Nationality Law, inherited from the Meiji Constitution, has been contested in various court cases and requires re-examination in light of global trends.”

Our next meeting is scheduled for July 31 at 5 PM in the same venue. Details will be shared later, but it will be another workshop rather than a formal conference style. The speaker will be ARAI Yukiyasu sensei. If you can assist, please let me know.
